Your access to and use of the Site is subject to these Terms of Use and all applicable laws. By accessing and using the Site, you accept these Terms of Use, without limitation. If you do not agree to the Terms of Use, do not use the Site. If, at any time, any part of the Terms of Use is no longer acceptable to you, immediately terminate your use of the Site.

Right to change, modify or delete the terms of use

CO2 AI reserves the right to change, modify, add or delete portions of these Terms of Use any time, without prior notice. We will notify you of any material changes by placing a prominent notice on the Site. Please re-review the Terms of Use periodically for changes. Your continued use of the Site and/or the Platform will mean that you accept such changes or deletions.

Access to the site

The Site aims to inform CO2 AI’s clients and potential clients about CO2 AI’s product and services and collect interest from them through a “request demo form”. Access to the Site does not require the creation of a user account. So long as you accept and comply with these Terms of Use, and unless we terminate them, we grant you a non-exclusive, non-transferable, royalty-free, revocable right to access and use the Site in accordance with these Terms of Use, strictly for your personal use.

Qualifications

The Site are available only to persons who are at least 18 years of age. Your right to use the Site is personal to you and cannot be transferred to any other person.

You shall be responsible for obtaining communication services, computer equipment and other products or services necessary to access and use the Site. You shall be responsible for all charges associated with accessing and maintaining a connection to the Site including, but not limited to, charges imposed by an Internet service provider, or your local telephone company.

Prohibited conduct

CO2 AI reserves the right to bar any such activity;

- using the Site or any Content for any purpose that is unlawful or prohibited by these Terms of Use, or to solicit the performance of any illegal activity or other activity which infringes the rights of CO2 AI or others.

Intellectual property

This Site and all the information it contains, or may in the future contain, such as articles, memoranda, bulletins, reports, press releases, opinions, text, directories, guides, photographs, illustrations, graphics, artwork, user interfaces, trademarks, trade names, service marks and logos (collectively, the “Content”), including but not limited to the design, structure, selection, coordination, expression, “look and feel” and arrangement of such Content, are the exclusive property of CO2 AI or/and of CO2 AI’s licensors, and are protected from unauthorized copying and dissemination by applicable intellectual property laws.
Except as expressly provided in these Terms of Use, no part of the Site and no Content may be copied, reproduced, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted or distributed in any way (including “mirroring”) to any other computer, server, Web site or other medium for publication or distribution or for any commercial enterprise, without CO2 AI’s express prior written consent.

In the absence of prior written authorization from CO2 AI or the intellectual property rights owner, any representation, reproduction, adaptation, or partial or total exploitation of the Content, by any process whatsoever, is likely to constitute an infringement within the meaning of articles L. 335-2 of the French Intellectual Property Code.

You may use information on CO2 AI products and services (such as data sheets, knowledge base articles, and similar materials) purposely made available by CO2 AI for downloading from the Site, provided that you (1) not remove any proprietary notice language in all copies of such documents, (2) use such information only for your personal, non-commercial informational purpose and do not copy or post such information on any networked computer or broadcast it in any media, (3) make no modifications to any such information, and (4) not make any additional representations or warranties relating to such documents.

Availability and security of the site

The Site may become unavailable to you as a result of maintenance, malfunction of computer hardware or software, or for other reasons, and may result in damages to your systems or operations. It is expressly reminded that the Internet is not a secure network. Restriction, suspension or termination

CO2 AI reserves the right, in its sole discretion, to restrict, suspend or terminate your access to all or any part of the Site at any time for any reason without prior notice or liability and without any obligation to refund any portion of fees paid for any product or service.
CO2 AI may change, suspend or discontinue all or any aspect of the Site at any time, including the availability of any Site feature, database, or content, without prior notice or liability.

The Site and the Content are delivered on an “as is and as available” basis. All information provided on the Site is subject to change without notice.
CO2 AI does not warrant that the Site or any Content will be uninterrupted or error-free, or that any defects will be corrected, or that your use of the Site will provide specific results.

Indemnification

You hereby agree to indemnify, defend and hold CO2 AI harmless from and against any and all liability, losses, costs and expenses (including attorneys’ fees) incurred by CO2 AI in connection with any claim arising out of any use or alleged use by you of the Site or arising out of or in relation to any breach by you of the Terms of Use. CO2 AI reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, and in such case, you agree to cooperate reasonably with CO2 AI’s defense of such claim.

Limitation of liability

Except where prohibited by law, in no event will CO2 AI be liable to you for any indirect damages.
If, notwithstanding the other provisions of these Terms of Use, CO2 AI is found to be liable to you for any damage or loss which arises out of or is in any way connected with your use of the Site or any Content, CO2 AI’s liability shall in no event exceed 100 €.

Governing law and jurisdiction

The Terms and Conditions shall be construed in accordance with the laws of France, without regard to conflict of laws principles.
In case of dispute, we invite you to contact us in priority via our email address dispute@co2ai.com, in order to find an amicable solution. In the absence of an amicable solution, any dispute relating to these Terms of Use will be submitted to the competent French courts.
